Henkilö, joka hätävarjelussa pahoinpideltyään toista niin, että tämä ei itse ollut kyennyt liikkumaan, ei ollut ryhtynyt toimenpiteisiin hoidon hankkimiseksi pahoinpidellylle, tuomittiin rangaistukseen toisen jättämisestä avuttomaan tilaan. RL 21 luv. 6 §:ää ei sovellettu.
